Proposal: Modify 10 U.S. Code § 10541 and DOD 7000.14-R to allow National Guard Reserve Equipment Appropriation funding to be used for software, not currently considered procurement.
Recommendation: Under the language of 10 U.S. Code § 10541 and DOD 7000.14-R, software is not considered procurement equipment and cannot be purchased with NGREA funding. Many capabilities and shortfalls that require material solutions can be addressed with commercial-off-the-shelf(COTS) software, but cannot be acquired with NGREA funding. Modifying language to allow use of NGREA funds would enable rapid acquisition of modern capabilities through existing funding resources at a service or component level. Not modifying NGREA would limit modernization efforts to each unit's respective budget for software purchases, and contribute to non-standardized solutions across the force.
