Provide adequate coverage to National Guard Soldiers and Airmen called to State Active Duty under the Uniformed Services Employment and Reemployment Rights Act (USERRA) of 1994.

Recommendation:
This is a recommendation to expand the coverage and protection provided by the Uniformed Services Employment and Reemployment Rights Act (USERRA) of 1994 to members of the National Guard called to State Active Duty. While the USERRA Act of 1994 provides coverage and protections to National Guard members called to duty under federal authority (such as Title 10 or Title 32), it does not provide those same protections for National Guard members called to duty under state authority; commonly referred to as State Active Duty (SAD). While many states may provide similar protections under state law, many do not. Expanding the USERRA coverage to National Guard members on SAD would standardize and ensure protection and coverage of our National Guard Soldiers and Airmen called to serve their home and state during times of need.
